What we can do for you

The concept of intellectual property extends to a broad range of rights that protect intellectual creations, including trademark rights, copyrights, trade name rights, and patents. Intellectual creations include photos, art, text, design, software, trade names, brands, and (technological) inventions. Third parties are not allowed to use your creations without your consent. Which intellectual property right would be suitable to protect your creation depends on the creation and the kind of protection you want.

Having your IP rights in order will strengthen your market position and your brand. It will also create opportunities for product development and innovation, while protecting your brand, product, or innovation against infringement. We will be happy to advise you on what steps to take.

The more popular the brand or product, the greater the chance it will be counterfeited. In many cases, recording your IP rights will act as a deterrent and mean that third parties will be less likely to market products that look too much like yours.

If a party infringes on your intellectual property rights, we will help you draft a clearly worded demand letter and, if necessary, litigate until we have secured compensation and legal costs.

We advise our clients on and initiate proceedings regarding the infringement and (in)validity of patents in all fields of technology. In our pharma- & biotechpractice we also advise and litigate with respect to SPCs and  PEs, taking regulatory aspects into account.

New technologies and digital products are developed all the time, such as AI (artificial intelligence) and blockchain. These also lead to a wide range of legal issues in realms such as copyright law, patents, trade secrets, and privacy and data protection.

Blockchain

Many have classed blockchain technology as the greatest innovation since the internet. High-profile people such as Bill Gates and Elon Musk have expressed confidence in the value added by blockchain technology. Blockchain technology is being used in many different industries. The blockchain paves the way for innovation and creates opportunities, but it also has a disruptive effect. Existing systems may be affected by blockchain technology, such as payments that so far are routed mainly through banks. What is undeniable is that blockchain technology not only offers theoretic solutions and improvements for existing problems and systems, but also offers many practical possibilities.

We have broad experience with the legal issues surrounding technology and will help you make well-considered choices for your IT projects and technological innovations. If necessary, we will work together in multidisciplinary teams with specialists in other areas of the law. 4. Trade secrets

Trade secrets play a key role in a company’s day-to-day operations and in the protection of knowledge sharing between companies. That said, it is far from a given that information is always properly protected at companies. Don’t put it off until it’s too late. Carefully assess what information you want to protect as a trade secret and then register it as such and take reasonable measures to keep this information confidential.

Dutch trade secret protection legislation defines the concept of ‘trade secret’, explains how to protect trade secrets, and specifies what legal means are available to take action against a party infringing on your trade secret. We will help you record your trade secrets adequately, assess possible infringements on your trade secret, and show you what steps you can take to protect your trade secret or deal with infringements.
